Abstract
Electronic and electrical waste (e-waste) is among the fastest-growing environmental problems and a potentially significant yet overlooked contributor to climate change. In India, the mismanagement of e-waste – through open burning, landfilling and informal recycling – leads to high emissions of greenhouse gases (GHGs), such as carbon dioxide (CO2) and methane (CH4), alongwith toxic pollutants. This paper examines the extended producer responsibility (EPR) in India to assess whether it helps reduce climate change through e-waste regulation. The study uses a doctrinal legal approach to identify key regulatory gaps, including the lack of carbon accounting, eco-design and emission-based incentives. It advocates for reforms in EPR laws to incorporate climate considerations and align with India’s nationally determined contributions (NDCs) and net zero 2070 targets – outlining policies that various stakeholders can adopt. To promote sustainable and climate-resilient e-waste management, India must strengthen its EPR framework with a focus on reducing GHG emissions.
